General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website www.mat-nak.com, operated by the company LOMSAWAN, official distributor of the MATNAK brand.

Hereinafter referred to as “the Seller” or “the Company”,
and any individual making a purchase on the website, hereinafter referred to as “the Customer” or “the Buyer”,

The following was agreed :

1. Purpose and Scope

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by the Company via the website www.mat-nak.com.

They are available for consultation at any time and must be accepted by the Customer before any order is placed. This acceptance constitutes full and unconditional validation.

The Company reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date the order is validated.

2. Price

Product prices are shown in euros, inclusive of all taxes (VAT), excluding delivery charges.
Applicable shipping costs are specified in the order summary, before validation.

The Seller reserves the right to modify its prices at any time. However, products will be invoiced based on the prices in effect at the time the order is registered.

In the event of a clear error (typographical or pricing error), the Seller will contact the Customer to offer an order with corrected terms. The Customer may then confirm or cancel the order.

For any order destined for abroad (outside the EU) or overseas territories, any customs duties and taxes remain the sole responsibility of the Buyer.

3. Products

The products offered for sale are those available on the website www.mat-nak.com, subject to availability.
Each item is described as accurately as possible. However, the photographs are not contractual.

4. Order

Creating a customer account is required for your first order.
The ordering process involves several steps: selecting products, validating your shopping cart, accepting the Terms and Conditions, and choosing your delivery and payment methods.
The sales contract is considered concluded upon confirmation of payment by the customer.

The Seller reserves the right to refuse an order in the event of a prior dispute or suspicion of fraud.

5. Payment

Payment is made online, in full and at the time of ordering, by one of the following methods :

  • Credit card (secure payment via SSL)
  • PayPal
  • Bank transfer (details provided upon validation)

Payment data is not stored by the site and does not pass through its servers.

6. Delivery

Products are delivered to the address provided by the Customer when placing the order. The Seller cannot be held liable for any errors in the address details.

Estimated delivery time in mainland France: 2 to 5 business days.
Maximum legal delivery time : 30 days (Article L.216-1 of the French Consumer Code). If this period is exceeded, the customer may request cancellation and a refund.

7. Right of withdrawal and returns

In accordance with the law (article L221-18 of the Consumer Code), the Customer has a period of 14 days from receipt of the order to exercise their right of withdrawal.

Return possible for :

  • Exchange
  • Credit
  • Refund

Terms :

  • Products are unused, in perfect condition, and in their original packaging
  • Return shipping costs are the responsibility of the customer (unless the error is ours)

Refunds are made within 14 days of notification of the right of withdrawal.

Products that are personalized or made to order are excluded from the right of withdrawal.

In case of an error on our part (size, model…), the return is taken care of by us up to the limit of standard costs (ex: Colissimo without signature).

8. Legal guarantees

All products benefit from the legal guarantees of conformity (articles L217-3 et seq. of the Consumer Code) and against hidden defects (article 1641 of the Civil Code).

The Customer has 2 years to invoke the legal guarantee of conformity.

Any complaint must be made to customer service within a reasonable time after the defect has been discovered.

9. Responsibility

The Company shall not be held liable for failure to perform the contract in the event of force majeure, disruption of the Internet network, or external intrusion.
Access to the site may be temporarily suspended without notice, particularly for maintenance.

10. Personal data

The personal data collected is essential for processing the order and issuing invoices.

In accordance with the GDPR and the French Data Protection Act, the Client has a right of access, rectification, erasure or objection, which can be exercised :

  • by mail to the address of the company LOMSAWAN
  • or via the “Contact” section of the website www.mat-nak.com

The Client can also manage their communication preferences in their personal space.

11. Applicable law and disputes

These Terms and Conditions are governed by French law.
In the event of a dispute, the French courts shall have exclusive jurisdiction.
